filed at the Registry on l June 2023 by Messrs P. Kuipers and D.A.M.H.W. Strik, lawyers of Amsterdam.
2. The review
2.1 Pursuant to Article 383(4) Fw, a hearing will be set at which the court will hear the confirmation. This (hybrid) hearing will take place in one of the courtrooms of the District Court of Amsterdam and via an online video link. Creditors and shareholders entitled to vote can apply to the registrar of the district court of Amsterdam to indicate
that they wish to participate in the hearing in person or digitally. It should be noted that there is limited space to physically participate in the hearing. Interested parties should therefore bear in mind that they can only participate digitally. In that case, they will receive a link from the Registrar to participate in the hearing via a video link.
2.2 In addition, pursuant to Section 383(5) of the Fw, the court will order SIHNV to give immediate written notice of this order to creditors and shareholders entitled to
vote.
2.3 Finally, the court considers that the process of reaching the plan, involving all stakeholders, has been lengthy and the case is voluminous and complex. The court will therefore take sufficient time to take note of the documents and will
therefore - in deviation of the provisions of Article 383(8) Fw - shorten the period within which any applications for rejection and views must be submitted.
3. The decision
The court:

3.1 stipulates that the hearing of the petition for confirmation of a plan
pursuant to article 383, paragraph 1, Fw will take place on Thursday 15 June 2023 at 10:00 a.m. before Judges A.E. de Vos, F. Damsteegt and P.J. Neijt;
3.2 decides that the hearing will take place in one of the courtrooms of the District Court of Amsterdam and via an online video link;
3.3 stipulates that creditors and shareholders entitled to vote may apply by e-mail (insolventies.amsterdam@rechtspraak.nl) to the clerk of the District Court of Amsterdam until no later than 16:00 on Tuesday 13 June 2023 to indicate whether they wish to participate in the hearing in person or digitally;
3.4 determines - in deviation from the provisions of Article 383 paragraph 8 Fw - that any requests for rejection of the confirmation must be submitted to the District Court no later than 12.00 on Tuesday 13 June 2023, one written copy of which must be delivered to the District Court of Rotterdam for the attention of Mr. F. Damsteegt, Insolvency Team;
3.5 requests the observers to submit their views in writing no later than Tuesday 13 June 2023 at 12.00, one written copy of which should also be delivered to the District Court of Rotterdam for the attention of Mr F. Damsteegt, Team Insolventie;
3.6 stipulates that SIHNV will inform the shareholders and creditors that are entitled to vote without delay in notify this decision (Article 383(5) Fw).
