We had an attorney conference today. The results are as follows.
Although we currently have about 6000 people who have registered with us in some way, about half of those people have not sent letters for the trustee.
The attorney stressed to us that it is the letters to the trustee ONLY that get counted in this request for an Equity Committee. There are about 3000 people who have registered on line, but have not sent in a letter. That remains the key sticking point.
If you have registered on line, but have not sent in a letter for the trustee, please do so. Although it is not necessary to do this to be helped by an Equity Committee (all shareholders, registered or not will be helped by an EC) it could make the difference between the court allowing an Equity Committee at all. Having the letters is crucial to our success.
I cannot stress the importance of the letter enough.
If you recently received an email from me (using my wrdsrus@aol address) we do not have your letter on file. Although you may have sent it or faxed it, we have not received it. We have received a significant number of faxes that were blank pages, or just black lines going down the page. We have also recieved some documents that were totally unrelated to this (such as medicare forms, and IRS forms) that contained personal information. When we received such a document, it was destroyed immediately. I suspect that these were people who dialed a wrong phone number when faxing.
We will soon be having a "call them all" for phone numbers we have identitifed as having no letter on file with us. This will be a recorded message, asking you to send your letter. I appologize for the inconvenience, but we simply have to tidy up our sharecount data.
If we can manage to get most of the people who registered on line, but did not send letters, we will have an incredible representation. The atty is very impressed with the numbers we have generated. Unfortunately, share data, without a letter, does us no good at all.
Some people have been concerned with us "upsetting the apple cart" by requesting an Equity Committee. Our atty has assured us, in the strongest terms, that this is simply NOT true. We and the attys are very well aware of all the court cases, and requesting an Equity Committee will not interfer with a positive outcome in any way. The attorney also emphasized that if we don't get an Equity Committee, we could very well be on the short end of the stick. Getting letters in is very, very important.
No one involved in the Bankruptcy Court has any motivation to make sure the shareholders get taken care of. That is why it is up to US to protect ourselves.
The atty is very encouraged by the numbers generated so far, but we'd like to see a lot more letters from the people who have registered and not sent letters.

There is a template for the letter on the website...click on Action Req and the link is at the bottom of the page. You can change the letter on that template, just do not eliminate the first sentance which identifies the case number, be sure to include your share count, type or print you full name, include your telephone number and sign the letter. Please limit your letter to one page. Letters without a signature cannot be counted either. This is very important.

For your convenience, here is the basic info...you may also handwrite the letter if you wish...but make sure you send it to us, not the trustee. Do not just print out this email, you should copy the letter into your word processing program or write this short letter by hand. Be sure to sign your letter and also type or print your name and telephone number. Telephone # is required so that if the trustee wishes to verify your shares, he has a way to contact you. I doubt the trustee will do that, but we need contact information for him, "just in case"' .
