Thank you for your email. I have attempted to respond to your two queries below. I have in fact been retained by AsiaPac with respect to the alleged "charges" issue. First of all let me say that I have read the German press account links below and they appear to be at complete odds with the facts. I can tell you that I find it highly irregular that a BaFin official or a German prosecutor would discuss charges with the press without having first notified the party who is charged and having otherwise made the contents of the charges available on the public record. As a result, I am highly skeptical of the veracity of what is said in the reports for which you have provided links. I can however unreservedly tell you that AsiaPac has never to my knowledge received any communications from any regulator accusing the company or any principal thereof of a wrongdoing. With respect to your other comments about the "plans of Mr. Lee", my retainer does not extend to that issue. I would expect that management will make their plans known in the ordinary course but I have told Mr. Lee that he cannot discuss these types of issues with one investor as that would constitute what is referred to as "selective disclosure" since all participants in the market must be made aware of material information at the same time. (m.M.) |
