I'm in Chicago not far from Madison ,wi. - forcasting anywhere from 15 to 30 inches of snow by Wednesday afternoon. Everything will be closed Wednesday. I work at a Ford Dealer and I bet we'll be closed - at least I'm not going to show up. O'Hare Airport is already cancelling flights.

wenn beide konflikt Parteien keine Fortschritte über die Problemen erreichen, dann wird sich 30 tagen nach der Einreichungs dieser Antrags einen  Vermittler einschalten.

the parties can reach an early resolution does not serve the interest of Ambac, its estate, or the
economic stakeholders in this case in light of the amount in dispute in the adversary proceeding.
Assignment of this case for mediation will also reduce the costs incurred by Debtor-plaintiff
Ambac, thereby preserving assets for creditors, as well as costs incurred by the United States.
Moreover, a quick resolution of the tax litigation is necessary to allow Ambac to emerge from
bankruptcy and avoid the possibility of this case needing to convert to a Chapter 7 proceeding.
Prolonged litigation, however, would be costly and slow the administration of the bankruptcy

Ambac will die Probleme mit IRS schnell wir möglich beenden, um schnell wie möglich aus dem CH11 zu verlassen und die Umwandlung von CH11 zu CH7 zu vermeiden.

Ambac anspruch für NOLs ist 700 million bis zum September( inc. December über 800 milionen )$

und IRS Anspruch ist 708 millionen $.

Sehr interesante Beträge. Ich glaube , Sie streichen gegenseitig ihre Schulden durch oder einer zahlt zu den anderen kleinen rest Betrag!

ich habe vor 2 Monaten für USD 33'000 Amac Aktien bei USD 0.156 gekauft, ich liege im Moment nicht schlecht drin.

Was denkt ihr, wann könnte das Verfahren gegen Bank of Amerika und Bear Stearns frühestens zum Abschluss kommen?

Falls Ambac bei diesen beiden Klagen als Gewinner herausgeht,wird dies einen mächtigen Schub auf den Kurs geben.

Danke Leopard für deine total wichtigen und guten research Berichte! Hoffen wir wie du es sagst, dass IRS und Ambac wirklich zu diesen Konsens kommen! am 16. dürfte wieder eine starke Kursbewegung zu erwarten sein.  

Ist die Holding AFG zu ihren Anleihgläubigern. Der Wert für die Holding, damit für die Aktionöre, hat sich gigantisch erhöht.  

Letze und wichtige Hürde ist bei dem CH11 Prozess die Steuerfrage +NOLs mit IRS.

- Unsecured Kreditgeber( AFG Anleihs Gläubiger) ist auch an der Seite vom ambac. Das ist auch sehr gute Nachricht.

wenn ambac eine Kompromisse mit IRS finden würde, ich glaube dran, dann gibt es auch ein Zahlungsplan für ihren Gläubigern.

Das ist alles jetzt noch spekulation.

und noch eine wichtige Frage,

woher Kommt das Geld ?

-vieleicht von Put buy back;JP-Morgan oder BAC

-vielleicht ambac wird ihre Vemögen( muni books) gegen ihre Schulden als Garantie zu zeigen, damit günstige Kredit bekommen

- vielleicht kommt dazwischen irgendeine investor Black rock oder Vangraud;

- nach dem reh Plan kann man Rating erhöhung für AFG und AAC warten, damit ihre Kredit würdigkeit zu verbessern

We werden sehen . aber auf jeden Fall ab 16.2 ist für uns und für ambac sehr wichtige Datum!

 Wünschen und betten für Gerechtelösung.

Alles was die Holding braucht, ist ein Finzplan über einen 5 Jahreszeitraum, denn sie dem Gericht vorlegen kann. So kann sie CH11 verlassen.

Wenn nun also vorher hier Geld bei der AAC einspielt wird, am besten in der Höhe der Restsumme die sie den Policeholdern schulden, so kann die AAC der Holding sozusagen einen Kredit ausstellen, womit Ch11 vom Tisch ist.

Der Prozeß, in dem die Gläubiger der Holding sich an der Holding beteiligen möchten, können oder wollen, kann erst nach der ersten Märzwoche stattfinden, da bis hier hin mir bekannt ist, dass die Gläubiger erstmal alle ihre Forderungen beim Gericht einreichen müssen.  

Assured Rises as S&P Reviews Bond-Insurer Proposal

Assured Guaranty Ltd, the only bond insurer still writing new contracts on state and municipal debt, rose in New York trading as Standard & Poor’s analysts said they would take into account comments on a proposed change that would mean downgrading such guarantors.

Assured Guaranty, whose main insurance units are rated AA+ by S&P, rose as much as 3.5 percent today to $15.57 in New York Stock Exchange composite trading. Through yesterday, the shares had dropped 11.8 percent since S&P’s Jan. 24 announcement.

“I want to emphasize, this is a request for comment, we are seeking your feedback,” S&P analyst Mark Puccia said today on a conference call. The company considers its proposals “an upgrade,” he said.

S&P, a unit of New York-based McGraw-Hill Cos., is overhauling the way it grades the creditworthiness of bond insurers after the two biggest, MBIA Inc. and Ambac Financial Group Inc., and most of the others lost their top AAA ratings in 2008. S&P also changed its criteria for mortgage-backed bonds and other securities after assigning top ratings to financial instruments that later collapsed in value during the credit crisis.

“We could lower our ratings on existing investment-grade bond insurers by one or more rating categories if the proposed criteria are adopted, unless those insurers raise additional capital or reduce risk,” S&P said in a statement last week.

Under the bond insurance proposal, Assured Guaranty would have a capital shortfall of about $1.9 billion to support a AA credit rating, the company told investors during a conference call yesterday. Chief Executive Officer Dominic Frederico criticized the plan on the call, saying at one point “reality has to matter.”

Timing Matters

Investors on today’s call pressed Puccia and analyst Rodney Clark on timing of any downgrades. A caller who identified himself as an official with hedge fund Moore Capital Management LLC said bank regulators are giving companies several years to meet new international capital standards.

Downgrades may come in less than a year, Puccia said.

“We would talk to management about their willingness and ability to raise capital” or reduce risk through measures including reinsurance, he said. Those considerations would be balanced against the “need to come up with timely ratings decisions.”

Frederico said yesterday said that so-called unearned premium reserves should be included in the way S&P measures Assured Guaranty’s capital in the new tests, noting most of the company’s premiums are paid up front. Clark said the proposed methodology was designed to be “consistent with” the view of regulators.

S&P’s proposed changes include one for the leverage test, which assesses a bond insurer’s risk from guaranteeing debt relative to how much capital it holds.

S&P is accepting comments on its proposal through March 25.
