Danke, sag mal hast du eigentlich auch noch was anderes außer dieser Bude hier im Schädel? Hut ab was du hier innerhalb weniger Minuten an Informationen parat hast und nun ab unter die Erde und graben.

Comparison = Vergleich, tragen die Gläubiger hier eventuell die Seitens Steinhoff aufzubringende Vergleichssumme und daher gibt es keinen Haircut? ;-)

Ohne hier nun Euphorie wecken zu wollen, aber irgendwas muss hier ja noch kommen.

So.. wer ist denn der aktuelle Verantwortliche ??

 

Is nur der "Nominierte" für die Haltedauer, also der verwaltet die bisher nicht in Anspruch genommenen CVA Endansprüche. Wie damit zu verfahren ist siehe unten:
Jetzt kommt wieder so ein endlos langer Copy/paste Text aus den Dokumenten (1L-Agreement, S. 95):
"Cancellation of unclaimed CVA final entitlements
(a) For the purpose of this Clause 9.6:
"CVA Holding Period Expiry Date" means 5.00 p.m. (London time) on the date falling one year after the Restructuring Effective Date save to the extent extended in accordance with the terms of the Holding Period Agreement and notified by the Parent to the Agent pursuant to paragraph (b) below.
“Holding Period Agreement” means the SEAG Holding Period Agreement entered into or to be entered into between the Holding Period Nominee, the Parent, the Borrower, SEAG and Lucid Issuer Services Limited.
"Holding Period Nominee" means Steenbok Stichting CVA, a foundation incorporated under the laws of the Netherlands, having its official seat in Amsterdam, the Netherlands, having its office at Herengracht 466, 1017 CA, Amsterdam, the Netherlands, and registered with the Dutch Trade Register under number 74672002.
(b) The Parent shall notify the Agent within five Business Days in the event of any amendment, waiver and/or modification to the terms of the Holding Period Agreement.
(c) The Parent shall ensure that the Agent is copied on all notices sent in accordance with the Holding Period Agreement.
(d) On the CVA Holding Period Expiry Date, the Holding Period Nominee shall administer and/or disburse any of its Commitments in accordance with the terms of the Holding Period Agreement and the Parent shall notify the Agent of the occurance of the CVA Holding Period Expiry Date and of all such actions as are required to be taken by the Holding Period Nominee including any such action as is referred to in paragraphs (e) and (f) below (such notice to the Agent, a “Holding Period Notice”).
(e) Upon the occurrence of the CVA Holding Period Expiry Date and following receipt by the Agent of a Holding Period Notice, if the Holding Period Notice confirms that the Holding Period Nominee is required to irrevocably and unconditionally waive its right to, and cancel, any or all of its Commitments in accordance with the terms of the Holding Period Agreement, the Agent shall promptly take any and all such action required to cancel the relevant Commitments (without further instruction to effect the cancellation), whereupon those Commitments (and a corresponding portion of the relevant Loan) shall be reduced to zero and deemed cancelled accordingly for the purposes of this Agreement and all other Finance Documents.
(f) Upon the occurrence of the CVA Holding Period Expiry Date and following receipt by the Agent of a Holding Period Notice, if the Holding Period Notice confirms that the Holding Period Nominee is required to transfer its Commitments to the Borrower or an Affiliate of the Borrower, the Agent shall promptly take any and all such action required of the Agent under Clause 26 (Changes to the Lenders) to transfer the relevant Commitments to the Borrower (or the relevant Affiliate of the Borrower, as applicable) (without further instruction, whereupon those Commitments (and a corresponding portion of the relevant Loan) held by the Borrower (or the relevant Affiliate of the Borrower, as applicable) shall be irrevocably and unconditionally cancelled and reduced to zero for the purposes of this Agreement and all other Finance Documents.
(g) For the avoidance of doubt, nothing in this Clause 9.7, Clause 26 (Changes to the Lenders), or this Agreement more generally shall limit or restrict the transfer of any Commitments to or by the Holding Period Nominee, in each case in accordance with the terms of the Holding Period Agreement."

Also er sammelt diese und gibt sie am Ende, wenn sich der Gläubiger nicht gemeldet hat, frei.
Ich glaube die sollen  gespendet werden.
Hatten wir schon mal vor langer Zeit erwähnt.

Sollte es nach dem ›CVA Holding Period Expiry Date‹ noch nicht in Anspruch genommenen CVA Endansprüche geben, folgt entweder Punkt 5.4 oder Punkt 5.5:

5.4 Debt Buy-Back Steps
5.4.3 the CVA Holding Period Nominee shall, where it has sold and/or transferred Unclaimed Final Entitlements pursuant to this Clause 5 (Treatment of Unclaimed Final Entitlements following the CVA Holding Period Expiry Date) and having deducted costs and expenses it incurred in respect of such sale/transfer gift the proceeds of such sale/transfer as a donation to the Registered Charity in accordance with the provisions of the Deed of Incorporation,

5.5 Open Market Sale Steps
5.5.3 the CVA Holding Period Nominee shall, where it has sold and/or transferred Unclaimed Final Entitlements pursuant to this Clause 5 (Treatment of Unclaimed Final Entitlements following the CVA Holding Period Expiry Date), and having deducted costs and expenses it incurred in respect of such sale/transfer, gift the proceeds of such sale/transfer as a donation to the Registered Charity in accordance with the provisions of the Deed of Incorporation,

Gustaaf und Dirty, danke für den Input & ja spenden ist immer was feines, was soll der Geiz Steinhoff hat auch Geld im Überfluss dann spenden wir halt noch was, dieses CVA Verfahren ist wirklich das aller beste "Insolvenzverfahren" was ich in meinem Leben je gesehen habe, hier bekommen die Gläubiger 100% ihrer Forderungen + bis zu 10,75% Zinsen, Gebühren, Sonderkosten usw. werden komplett vom Schuldner bezahlt und ja logisch haut der Schuldner auch noch Geld für Spenden raus.

Ich komme da kopfmäßig nicht mehr mit...…. ;-)  

Die gläubiger kommen sogar mehr als 100% da sie die Schulden zu 60-70% gekauft haben... Einfach herrlich ;)

Beziehen sich die 60-70 % auf den Nennwert oder auf die tatsächlich in Anspruch genommene Summe?
Vom Nennwert her ergaben sie alle zusammengerechnet ca. 11,5 Mrd €.
Inanspruchnahme genommen waren aber nur die insgesamt ca. 8,5 Mrd €.
Hab da leider keine Antwort drauf und auch keine seriösen Quellen gefunden.  

Ich würde dich gerne bitten, den zusammenhangslosen, trivialen wie abfälligen Vergleich von  Steinhoffaktien mit Klopapier zu unterlassen. Wenn schon, dann bitte die Benchmark mit Fakten hinterlegen. Ich habe das bereits am 31.10. hier mit klaren, nachvollziehbaren Zahlen versucht und gepostet. Demnach befinden wir uns immer noch im Hochpreissektor aller handelsüblichen                           Schei.. hauspapiere, siehe Postanhang von damals. Wir brauchen hier nützliche Relationen in jeder Phase, auch besonders dann, wenn sich derzeit Klopapier extrem gut dafür eignet, ja, sich  förmlich dafür anbiedert. Ich geb jedoch offen zu, dass es im Moment etwas schwer ist immer professionell und sachlich zu kommentieren.  

Das kann ich dir nicht beantworten, ist auch für uns Aktionäre relativ egal ;)  

Habe das Thema nicht angeschnitten, wenn es denn so egal ist.
Egal ist mir momentan nur der Kurs, da brauchen wir für die nächsten Monate nur informatorisch draufschauen.

Ich lese nicht alle Dokumente weil es sich zeitlich nicht ausgeht und das sind keine Texte die man mal eben so nebenbei lesen kann auf Grund der Komplexität... Ich vermute aber dass du nirgends im Detail herausfinden kannst zu welchem Preis die Hedgefonds die Kredite gekauft haben... Viele waren Anleihen daher kommen wir auf den Kurs von 60 bis 70% und bei Anleihen ist es immer zur Gänze ausgenutzt...  

Ist doch richtig was ich schreibe.Markus Krall ist anerkannter Experte im Bereich Finanzen.
Er hat jahrelang Risikomanagmentsysteme für Großbanken entwickelt.  

Du kannst den User wieder entsperren, er hatte mir den Text auch geschickt, ich hatte ihn aber gefragt ob ich es posten kann und er hat zugestimmt. Ich fand da jetzt auch nichts weltbewegendes dran und habe ihn dann einfach ohne Kommentar gepostet. Du kannst ihn wieder frei schalten er tauscht sich gerne aus mit Dir.
