It is allabout the $20M break up fee. The main issue here (in my layman'sopinion) is whether the fact that Investment Canada blocked the deal,impacted Forsys right to terminate it. I think not but I am not a legalexpert.
In any case, if you have been following Forsys for some time thedocuments make an interesting read with unknown Middle Eastern interestsfailing to cough up the dough.
The bottom line is that when the case is finally finished Forsys canmove forward (this may be impacting the JV/financing). If they win thatis icing on the cake.

fazit 1: für uns nichts neues, dass gfi die 150 mio. usd klage nur initiiert hat, um von der 20 mio. usd vertragsstrafe abzulenken. auch klar, dass gfi die vertragsstrafe nicht bezahlen möchte. es bleibt eindeutig am ehemaligen ceo hängen, sich mit so einem fadenscheinigen und unseriösen geschäftspartner eingelassen zu haben. noch dazu, wenn allgemein bekannt sein muss (in der uranbranche), dass g.forrest mit glencore, areva, sg, ... dick verbandelt ist. auch allgemein bekannt, dass areva forsys nur zu gerne billig übernommen hätte. wer weiss, was hier wirklich gespielt wurde !
fazit 2: der claim von gfi ist definitiv chncenlos ! bleibt abzuwarten, inwieweit forsys die 20 mio. cad vertragsstrafe durchbringt !
